I really dislike that these matters are often initially decided by a random jury. Nearly everything related to software is non-obvious to a layperson, so how are they supposed to rule on patentability, and subtle infringements? I don't have a better answer, since narrower pools of jurors would have certain biases, but I feel this is a huge problem.

I have this (most likely irrational) fear that one day I'll be on trial related to some work I've done, and my fate will be decided by 12 average people, who are decidedly not my peers, and don't have the background (or capacity even) to understand the relevant concepts of the case.
